ALRUD experts talk about cross-border disputes

On February 13, ALRUD Law Firm held a seminar on "Cross-border disputes: Topical issues and practice of Russian courts".

During the seminar, the speakers paid attention to the recent increase in disputes in Russian courts involving foreign entities. In particular, while many disputes involving Russian business are still being considered in foreign jurisdictions, the issues of subsequent recognition and enforcement of decisions of foreign courts and arbitrations in Russia are still relevant. The issues of cross-border bankruptcy in Russia and the application of foreign law in transactions also remain on the front burner. Meanwhile, the Russian legislator deliberately tries to return some corporate disputes to the Russian jurisdiction.

Despite the attention of legislators and highest courts to cross-border disputes, many complex, practical issues remain unresolved, thus causing considerable difficulties for the parties to the dispute.

During the seminar, the experts detailed the latest trends in court practice and shared their experience in the field of recognition and enforcement of decisions of foreign courts and cross-border bankruptcy, revealed challenging issues of arbitration of cross-border disputes, discussed the recent clarifications of the Supreme Court of Russia and gave practical recommendations on working with foreign law in Russian courts.
