Margarita Egiazarova Contributes Expert Commentary to “Labour Disputes” Journal

Margarita Egiazarova, PhD in Law, Partner and Head of the Labour Law Practice at ALRUD, contributed an expert commentary to the latest issue of the professional journal Labour Disputes. The article is titled: “Dismissals and Disciplinary Measures: Why Standard Documents Are No Longer Enough – and What to Add”.

In her memo, Margarita highlights a significant shift in judicial practice: Russian courts are increasingly examining the actual circumstances surrounding a dismissal agreement, rather than its formal wording – focusing on whether the employee’s decision was truly informed and voluntary, and whether the employer acted in good faith and with transparency.

As Margarita notes, standard clauses in such agreements are no longer sufficient. She recommends implementing a separate post-signing notification, issued to the employee after the agreement is signed but before the dismissal order is issued. This document confirms that the consequences of the termination were clearly explained, and that the employee had an opportunity to ask questions and review the final settlement.

This type of notification serves as reliable evidence of the employee’s active participation in the process and the absence of any pressure, Margarita emphasizes.
